These terms govern your purchase and use of beats, licenses, sound kits and subscription plans from JANI ("JANI", "we", "us"), sold through this website. By paying for or downloading anything, you ("you", "Licensee") agree to these terms.
You are buying a license to use a musical work (a "beat"), not ownership of it. JANI keeps all copyright in the beat and its recordings. Nothing here transfers ownership unless a written agreement signed by JANI says so.
Each beat is licensed under the tier you buy (Basic, Premium, Unlimited or Exclusive). The tier summary on the License terms page and the license agreement delivered with your order set the limits for that purchase. If they differ, the delivered agreement controls.
Basic, Premium and Unlimited are non-exclusive, non-transferable, worldwide licenses to incorporate the beat into one new song (a "Song") and to reproduce, distribute, stream and perform that Song within the limits of your tier. JANI may keep selling and licensing the same beat to others.
Basic: MP3 file; one Song; up to 50,000 combined audio streams; one music video. Premium: WAV file; one Song; up to 250,000 combined audio streams; one music video. Unlimited: WAV and stems; one Song; unlimited streams and music videos; radio and live performance.
If your Song passes its stream limit, you must upgrade to a higher tier before further distribution. You own your own lyrics, vocals and other original contributions to the Song.
Stems are produced from the finished beat using automated (AI) source separation, and where a beat was not exported as individual tracks they are generated at the time of purchase and emailed to you when ready. They are not the original project tracks, so you may hear slight bleed or artifacts between parts. This is not a defect and does not change your license.
An Exclusive license gives you sole rights to use the beat in Songs for as long as the license is in force: JANI will stop selling and licensing the beat to others and will remove it from the store. Non-exclusive licenses already sold before your purchase remain valid for their holders and continue for the Songs they cover. Exclusivity is a license, not a copyright assignment, and JANI keeps ownership of the beat and may use it as a portfolio sample.
Exclusive packs include one or two additional beats. Each additional beat carries the same lease rights as the first beat in the pack, as stated on the pack page, and is covered by the delivered license agreement.
You may not: resell, sublicense, give away or redistribute the beat or its stems on their own; upload the beat alone to a music library, sample pack, beat store or streaming service; register the beat or your Song in a content ID or fingerprinting system unless your delivered license says so; claim you created the beat; or use the beat in hateful, unlawful or defamatory content.
You must credit "Prod. by JANI" in the title or description wherever the Song is released on streaming platforms and video platforms, and in metadata where the platform allows.
Some beats may contain licensed or cleared elements. JANI represents that the beat is original or that JANI holds the rights necessary to grant your license, but JANI does not warrant that a beat is free of third-party claims beyond that. If a claim arises, tell us promptly so we can work with you to resolve it, including by replacing the beat. Our liability for any claim relating to a beat is limited to a refund of the amount you paid for that beat.
Prices are in US dollars. Payments are processed by Stripe; JANI does not see or store your card number. Applicable sales or use tax may be added where required by law.
Files, license agreement and any stems are delivered electronically to the email address you gave at checkout, usually within 24 hours of payment, and sooner when automatic delivery is running. Make sure the email is correct and check your spam folder. Download links may expire, so save your files when you receive them.
Plans (Writer, Artist, Label) renew automatically each month or year until cancelled. Each billing period includes the licenses and perks listed on the plan page. Unused monthly licenses do not roll over unless the plan page says so. To cancel, use the billing portal at https://billing.stripe.com/p/login/bJe28q7rGeXo3ZQegxdwc00 (sign in with your purchase email) or email [email protected] before the next renewal date; cancellation stops future charges and the plan stays active until the end of the period you paid for. Prices may change with at least 30 days notice before your next renewal.
Promo codes apply only as stated at checkout, cannot be combined unless stated, and do not apply to Exclusive licenses or packs. Partner links track referrals; JANI may withhold commissions for fraud, self-referral or refunded orders.
If you break these terms or your license, JANI may terminate that license after written notice and a reasonable chance to fix the problem, except where the breach cannot be fixed. After termination you must stop distributing the affected Song, with no refund. Songs distributed before termination and within the license limits are not affected.
The beats and website are provided "as is". To the fullest extent the law allows, JANI disclaims all other warranties, and is not liable for indirect, incidental or consequential damages, lost profits or lost revenue. JANI's total liability for any claim is limited to the amount you paid for the order that gave rise to it.
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You and JANI agree that courts located in Texas have exclusive jurisdiction, except that either party may seek urgent relief to protect intellectual property in any competent court.
We may update these terms. Changes apply to purchases made after the update date shown at the top. The terms in force when you paid govern your order.
